1. Introduction

By accessing or using Racqix's Services, you agree to be bound by these Terms of Use, including our Privacy Policy, Cookie Policy, and Safety Guidelines. Please read these terms carefully before using our Services.

The terms “us”, “we”, “Company” and “Racqix” refer to Racqix. Together you and Racqix may be referred to as the “Parties”.

2. Account Eligibility

You are not authorized to create an account or use our Services unless all of the following are true:

  • You are at least 18 years old
  • You are legally qualified to enter a binding contract with Racqix
  • You are not prohibited from using our Services by applicable law
  • You have not been convicted of a felony or indictable offense
  • You are not required to register as a sex offender
  • You have not previously been removed from our Services

3. Content

3a. Your Content

You are solely responsible for Your Content, and you agree to indemnify us for any claims related to Your Content. Content must be:

  • Accurate and truthful
  • Not contain any Prohibited Content
  • Comply with our Community Guidelines

3b. Member Content

Other users will share content on our Services. Member Content belongs to the user who posted it. You may not copy or use Member Content for any purpose except as contemplated by these Terms.

4. Platform Features and Services

4a. Matching System

Our matching system is designed to connect users based on various factors including, but not limited to:

  • Skill level and playing experience
  • Location and availability
  • Playing preferences and style
  • Match history and user ratings

While we strive to provide quality matches, we do not guarantee the compatibility, skill level, or behavior of matched users.

4b. Messaging and Communication

When using our messaging features:

  • Messages must be related to arranging matches or discussing racquet sports
  • You may not send spam, advertisements, or promotional content
  • Harassment, hate speech, or inappropriate content is strictly prohibited
  • We may review, screen, and delete messages that violate these terms
  • Do not share personal contact information until you feel comfortable

4c. Rating and Review System

Our rating system helps maintain community standards. When using this feature:

  • Provide honest and fair ratings based on actual matches
  • Do not manipulate ratings through false accounts or coercion
  • Ratings should reflect playing experience and sportsmanship
  • We reserve the right to remove or adjust manipulated ratings

5. Detailed User Conduct

5a. Match Conduct

When participating in matches:

  • Arrive on time for scheduled matches
  • Provide reasonable notice for cancellations (minimum 6 hours)
  • Play fairly and follow standard rules of the sport
  • Maintain appropriate behavior and sportsmanship
  • Report any safety concerns or inappropriate behavior

5b. Prohibited Activities

The following activities are strictly prohibited:

  • Commercial solicitation or promotion
  • Gambling or betting on matches
  • Harassment or intimidation of other users
  • Misrepresentation of skill level or experience
  • Creating multiple accounts
  • Sharing or selling account access
  • Using the platform for non-sports related purposes

6. Refunds and Payment Disputes

6a. Refund Policy

Our refund policy is as follows:

  • Subscription fees are non-refundable except where required by law
  • Promotional or discounted subscriptions are not eligible for refunds
  • Refund requests due to technical issues will be evaluated case by case
  • Unused subscription time is not refundable upon account deletion

6b. Chargebacks

Regarding payment disputes and chargebacks:

  • Filing a chargeback may result in immediate account suspension
  • Disputed charges must first be addressed through our support team
  • Fraudulent chargebacks may result in permanent account termination
  • Users are responsible for chargeback fees where applicable

7. Regional Terms

7a. European Union Users

Additional rights for EU users include:

  • 14-day cooling-off period for digital content
  • Right to data portability
  • Right to be forgotten
  • Local consumer protection laws apply

7b. California Users

California residents have additional rights including:

  • California Consumer Privacy Act (CCPA) rights
  • Right to know what personal information is collected
  • Right to delete personal information
  • Right to opt-out of data sales

7c. Canadian Users

For users in Canada:

  • Personal Information Protection and Electronic Documents Act (PIPEDA) compliance
  • Quebec Privacy Law compliance where applicable
  • Right to access personal information
  • Language laws compliance in Quebec

8. Prohibited Activities

You agree NOT to:

  • Use the Services for any illegal purpose
  • Impersonate any person or entity
  • Harass or stalk any other user
  • Post any Prohibited Content
  • Solicit money from other users
  • Spam other users
  • Use any robots, spiders, or scrapers
  • Circumvent our filtering mechanisms

9. Premium Services and Payments

9a. External Service Purchases and Subscriptions

External Service Purchases, including subscriptions, may be processed through the External Service, in which case those purchases must be managed through your External Service Account. Subscriptions automatically renew until you cancel.

When making a purchase on the Service, you may have the option to pay through an External Service, such as with your Apple ID or Google Play account (“your External Service Account”), and your External Service Account will be charged for the purchase in accordance with the terms disclosed to you at the time of purchase and the general terms applicable to your External Service Account. Some External Services may charge you sales tax, depending on where you live, which may change from time to time.

If your External Service Purchase includes an automatically renewing subscription, your External Service Account will continue to be periodically charged for the subscription until you cancel. After your initial subscription commitment period, and again after any subsequent subscription period, the subscription will automatically continue for the price and time period you agreed to when subscribing. If you received a discounted promotional offer, your price may go up per the terms of that offer following the initial subscription period for any subsequent renewal period.

Cancellation of External Service Purchases

If you do not want your subscription to renew automatically, or if you want to change or terminate your subscription, you must log in to your External Service Account and follow instructions to manage or cancel your subscription, even if you have otherwise deleted your account with us or if you have deleted the App from your device.

  • For Apple ID subscriptions: Cancellation is handled by Apple, not Racqix. To cancel a purchase made with your Apple ID, go to Settings within the app, and follow the instructions to cancel. You can also request assistance at Apple Support.
  • For Google Play subscriptions: Cancellation is handled by Google. To cancel a purchase made through Google Play, launch the Google Play app on your mobile device and navigate to Settings. You can also request assistance at Google Play.

If you cancel a subscription, you may continue to use the canceled service until the end of your then-current subscription term. The subscription will not be renewed when your then-current term expires.

If you initiate a chargeback or otherwise reverse a payment made with your External Service Account, Racqix may terminate your account immediately in its sole discretion, on the basis that you have determined that you do not want a Racqix subscription. In the event that your chargeback or other payment reversal is overturned, please contact Customer Care. Racqix will retain all funds charged to your External Service Account until you cancel your subscription through your External Service Account.

9b. Internal Purchases and Subscriptions

Internal Purchases, including subscriptions, are processed using the Payment Method you provide on the Website or App. Subscriptions automatically renew until you cancel.

If you make an Internal Purchase, you agree to pay the prices displayed to you for the Services you've selected as well as any sales or similar taxes that may be imposed on your payments (and as may change from time to time), and you authorize Racqix to charge the payment method you provide (your “Payment Method”). Racqix may correct any billing errors or mistakes even if we have already requested or received payment.

Automatic Renewal and Cancellation

If your Internal Purchase includes an automatically renewing subscription, your Payment Method will continue to be periodically charged for the subscription until you cancel. After your initial subscription commitment period, and again after any subsequent subscription period, your subscription will automatically continue for the price and time period you agreed to when subscribing, until you cancel.

To cancel a subscription, log in to the Website or App and go to the Account section. If you cancel a subscription, you may continue to use the cancelled service until the end of your then-current subscription term. The subscription will not be renewed when your then-current term expires.

Payment Method Updates

You may edit your Payment Method information by using the Settings tool. If a payment is not successfully processed, due to expiration, insufficient funds, or otherwise, you remain responsible for any uncollected amounts and authorize us to continue billing the Payment Method, as it may be updated. This may result in a change to your payment billing dates.

You authorize us to obtain updated or replacement expiration dates and card numbers for your credit or debit card as provided by your credit or debit card issuer. The terms of your payment will be based on your Payment Method and may be determined by agreements between you and the financial institution, credit card issuer, or other provider of your chosen Payment Method.

9c. Pricing and Promotional Offers

Racqix operates a global business, and our pricing varies based on a number of factors. We frequently offer promotional rates - which can vary based on region, length of subscription, bundle size, past purchases, account activity and more. We also regularly test new features and payment options.

If you do not timely cancel your subscription, your subscription will be renewed at the full price as indicated when the purchase was made, without any additional action by you, and you authorize us to charge your payment method for these amounts.

To the extent permissible by law, we reserve the right, including without prior notice, to:

  • Limit the available quantity of or discontinue making available any product, feature, service or other offering
  • Impose conditions on the honoring of any coupon, discount, offer or other promotion
  • Bar any user from making any transaction
  • Refuse to provide any user with any product, service or other offering

10. Account Termination

10a. Account Deletion by User

You may delete your account at any time by:

  • Going to Account Settings
  • Selecting “Delete Account”
  • Following the confirmation process

Please note:

  • Account deletion is permanent and cannot be reversed
  • All your data will be deleted except as required by law
  • Active subscriptions must be cancelled separately through your External Service Account
  • No refunds will be provided for unused subscription time
  • Messages and content shared with other users may remain visible

10b. Account Termination by Racqix

We may suspend or terminate your account:

  • Immediately and without notice for:
    • Violations of these Terms
    • Fraudulent activity or payments
    • Harassment or abuse of other users
    • Creating multiple accounts
    • Sharing account credentials
    • Providing false information
  • With notice for:
    • Extended periods of inactivity
    • Service discontinuation
    • Platform maintenance or updates

10c. Effects of Termination

Upon account termination:

  • You lose access to all Services and features
  • Your profile and content will be removed from view
  • Scheduled matches will be cancelled
  • You may not create a new account without our permission
  • Legal obligations and rights survive termination

11. Safety and User Verification

RACQIX DOES NOT CONDUCT CRIMINAL BACKGROUND OR IDENTITY VERIFICATION CHECKS ON ITS USERS.

11a. User Safety Responsibilities

You are solely responsible for:

  • All interactions with other users
  • Verifying the identity and skill level of users you meet
  • Your physical safety during matches
  • Your personal belongings and equipment
  • Following proper safety protocols for your chosen sport
  • Reporting suspicious or dangerous behavior

11b. Safety Guidelines

For your safety, we strongly recommend:

  • Initial Meetings:
    • Meet at established sports facilities or clubs
    • Choose well-lit, populated venues
    • Inform friends or family of your plans
    • Share your location with trusted contacts
    • Arrange your own transportation
    • Avoid private or secluded locations
  • During Matches:
    • Stay in public areas of the facility
    • Keep your belongings secure
    • Maintain appropriate physical boundaries
    • Stay sober and alert
    • Trust your instincts

11c. Emergency Situations

In case of emergency:

  • Contact emergency services immediately (dial local emergency number)
  • Report the incident to facility staff if applicable
  • Report the incident to Racqix through our support channels
  • Document any relevant information
  • Seek medical attention if needed

11d. Sport-Specific Safety

Users must:

  • Use appropriate protective equipment for their sport
  • Follow standard rules and safety protocols
  • Play within their skill level
  • Disclose any relevant health conditions
  • Stop play if unsafe conditions arise

12. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

12a. Service Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. RACQIX SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS
  • ACCURACY, RELIABILITY, OR COMPLETENESS OF THE SERVICES
  • UNINTERRUPTED OR ERROR-FREE OPERATION
  • SECURITY FROM UNAUTHORIZED ACCESS
  • BACKUP OR STORAGE OF YOUR DATA

12b. User Interaction Disclaimers

RACQIX DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR:

  • THE CONDUCT, SAFETY, OR LEGITIMACY OF ANY USER
  • THE TRUTH OR ACCURACY OF USER PROFILES OR CONTENT
  • THE SKILL LEVEL OR EXPERIENCE OF ANY USER
  • THE QUALITY OR OUTCOME OF ANY MATCH OR INTERACTION
  • THE SAFETY OR CONDITION OF SPORTS FACILITIES OR EQUIPMENT
  • THE BEHAVIOR OR ACTIONS OF ANY USER DURING OR AFTER A MATCH

12c. Third-Party Disclaimers

RACQIX MAKES NO WARRANTIES REGARDING:

  • THIRD-PARTY WEBSITES OR SERVICES LINKED TO OR FROM OUR SERVICES
  • PAYMENT PROCESSORS OR PAYMENT METHODS
  • SPORTS FACILITIES OR VENUES
  • ADVERTISEMENTS OR PROMOTIONS BY THIRD PARTIES
  • EQUIPMENT OR PRODUCTS MENTIONED OR USED BY USERS

12d. Health and Safety Disclaimers

YOU ACKNOWLEDGE AND AGREE THAT:

  • RACQUET SPORTS INVOLVE INHERENT RISKS OF PHYSICAL INJURY
  • YOU PARTICIPATE IN MATCHES AT YOUR OWN RISK
  • YOU ARE RESPONSIBLE FOR YOUR OWN MEDICAL AND HEALTH CONDITIONS
  • YOU SHOULD CONSULT WITH A PHYSICIAN BEFORE PARTICIPATING
  • YOU ASSUME ALL RISKS ASSOCIATED WITH YOUR PARTICIPATION

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

13a. General Limitations

IN NO EVENT SHALL RACQIX, ITS DIRECTORS, OFFICERS, SHAREHOLDERS, EMPLOYEES, AFFILIATES, OR AGENTS BE LIABLE FOR:

  • ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES
  • PERSONAL INJURY OR BODILY HARM ARISING FROM USE OF THE SERVICES
  • EMOTIONAL DISTRESS OR PSYCHOLOGICAL HARM
  • LOSS OF REVENUE, PROFITS, OR BUSINESS OPPORTUNITIES
  • LOSS OF DATA OR DAMAGE TO DEVICES
  • ANY RESULT OF HACKING, TAMPERING, OR UNAUTHORIZED ACCESS
  • ANY COMMUNICATIONS OR INTERACTIONS WITH OTHER USERS

13b. Liability Cap

RACQIX'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES SHALL NOT EXCEED THE GREATER OF:

  • THE AMOUNT PAID BY YOU TO RACQIX IN THE 12 MONTHS PRIOR TO THE ACTION GIVING RISE TO LIABILITY
  • $100 USD (OR EQUIVALENT IN LOCAL CURRENCY)

13c. Sport-Specific Limitations

RACQIX IS NOT LIABLE FOR:

  • ANY INJURIES SUSTAINED DURING SPORTS ACTIVITIES
  • DAMAGE TO OR LOSS OF SPORTS EQUIPMENT
  • FACILITY OR VENUE CONDITIONS
  • ACTIONS OR BEHAVIOR OF OTHER PLAYERS
  • MISREPRESENTATION OF PLAYER SKILL LEVELS
  • DISPUTES ARISING FROM MATCH RESULTS OR CONDUCT

13d. Time Limitation

ANY CLAIM AGAINST RACQIX MUST BE BROUGHT WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ARISES.

14. Dispute Resolution

14a. Informal Resolution

Before initiating any formal dispute resolution:

  • Contact Racqix support at connect@racqix.com
  • Provide detailed information about your dispute
  • Allow 30 days for us to respond and attempt resolution

14b. Binding Arbitration

IF INFORMAL RESOLUTION FAILS, YOU AND RACQIX AGREE THAT ANY DISPUTE SHALL BE RESOLVED THROUGH BINDING ARBITRATION, EXCEPT:

  • Small claims court cases
  • Intellectual property disputes
  • Claims for emergency injunctive relief

14c. Arbitration Rules

The arbitration will be conducted:

  • By a neutral arbitrator
  • In English language
  • In accordance with Canadian arbitration laws
  • Using simplified procedures for claims under $10,000
  • Via telephone or video conference when possible

14d. Class Action Waiver

YOU AND RACQIX AGREE THAT:

  • EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY
  • NO CLAIMS WILL BE BROUGHT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION
  • NO ARBITRATOR MAY CONSOLIDATE OR JOIN CLAIMS FROM OTHER PERSONS
  • NO CLASS ARBITRATION PROCEEDINGS ARE PERMITTED

14e. Costs of Arbitration

Regarding arbitration costs:

  • Each party will pay their own attorney fees
  • Filing fees will be split equally unless otherwise awarded
  • The arbitrator may award costs to the prevailing party

16. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page. Your continued use of the Service after such modifications constitutes your acceptance of the modified Terms.

17. Digital Millennium Copyright Act

Racqix has adopted the following policy towards copyright infringement in accordance with the Digital Millennium Copyright Act (the “DMCA”). If you believe any Member Content or Our Content infringes upon your intellectual property rights, please submit a notification alleging such infringement (“DMCA Takedown Notice”) including the following:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate the material;
  • Your contact information, including your address, telephone number, and email;
  • A statement that you have a good faith belief that use of the material is not authorized by the copyright owner; and
  • A statement that the information in the notification is accurate and, under penalty of perjury, you are authorized to act on behalf of the copyright owner.

By using our Services, you consent to our data practices as described in our Privacy Policy.

19. Indemnification

You agree to indemnify, defend, and hold harmless Racqix, its affiliates, officers, directors, employees, agents, licensors, and service providers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from:

  • Your violation of these Terms
  • Your use of the Services
  • Your violation of any rights of another
  • Your conduct in connection with the Services

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.

20. Force Majeure

Racqix shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to:

  • Acts of God
  • War or terrorist actions
  • Pandemics or health emergencies
  • Laws or governmental actions
  • Market conditions or economic crisis
  • Strikes or labor difficulties
  • Internet or telecommunications failures
  • Power outages or shortages

21. Intellectual Property Rights

21a. Ownership of Service

The Services, including but not limited to:

  • Software
  • Algorithms and matching system
  • User interface and design
  • Logos and trademarks
  • Text and graphics
  • Audio and video content
  • Database rights
  • Patents and inventions

are owned by or licensed to Racqix and are protected by intellectual property laws.

21b. Limited License

Subject to these Terms, Racqix grants you a limited, non-exclusive, non-transferable, non-sublicensable license to:

  • Access and use the Services for personal, non-commercial purposes
  • Download and install the mobile application on your personal devices
  • Use features and functionalities made available to your account level

21c. Restrictions

You may not:

  • Copy, modify, or create derivative works of the Services
  • Reverse engineer or decompile any part of the Services
  • Remove or alter any copyright or trademark notices
  • Use our intellectual property without express written permission
  • Scrape or extract data from the Services
  • Use the Services for commercial purposes

21d. User Content License

By posting content on the Services, you grant Racqix a worldwide, non-exclusive, royalty-free license to:

  • Use, copy, and display your content
  • Create derivative works from your content
  • Sublicense these rights to our service providers
  • Use your content for promotional purposes

This license survives termination of your account.

22. Virtual Items and Currency

22a. Virtual Currency

Virtual Currency includes but is not limited to:

  • Racqix Credits
  • Bonus Points
  • Reward Tokens
  • Any other virtual credits or points

22b. Virtual Items

Virtual Items include but are not limited to:

  • Premium Match Credits
  • Profile Boosts
  • Special Badges
  • Achievement Trophies
  • Profile Customization Options

22c. License and Restrictions

Regarding Virtual Items and Currency:

  • They are licensed, not sold, to you
  • License is limited, revocable, non-transferable, and non-sublicensable
  • No actual ownership rights are granted
  • They have no cash value or real-world equivalent
  • They cannot be converted back to real money
  • They cannot be traded or transferred between accounts
  • They cannot be sold or exchanged outside the Service

22d. Expiration and Termination

Virtual Items and Currency:

  • May expire after a specified time period
  • May be removed from your account at any time
  • Are forfeited upon account termination
  • Are not refundable or replaceable if lost
  • May be modified or discontinued at any time

23. Age Restrictions and Verification

23a. Age Requirements

You must meet the following age requirements:

  • Be at least 18 years old to create an account
  • Be at least 18 years old to use any features of the Service
  • Be of legal age in your jurisdiction to enter into contracts
  • Be of legal age to participate in sports activities

23b. Age Verification

Racqix reserves the right to:

  • Request proof of age at any time
  • Suspend accounts pending age verification
  • Terminate accounts for age requirement violations
  • Report underage users to appropriate authorities

23c. Parental Consent

For users under local legal adult age but over 18:

  • Parental or guardian consent may be required
  • Parents/guardians are responsible for supervision
  • Parents/guardians assume liability for user actions
  • Parents/guardians must agree to these Terms

23d. Reporting Underage Users

If you become aware of an underage user:

  • Report the account immediately to connect@racqix.com
  • Provide any relevant information about the user
  • Do not engage with the underage user
  • Block the account if necessary

24. Data Retention and Deletion

24a. Data Retention Period

Racqix retains different types of data for varying periods:

  • Account Information:
    • Active accounts: Duration of account existence
    • Deleted accounts: Up to 30 days after deletion
    • Payment information: As required by law
    • Match history: Up to 12 months
  • Communications:
    • Chat messages: Duration of account existence
    • Support tickets: 24 months
    • Dispute records: 36 months
  • Usage Data:
    • Login history: 12 months
    • Device information: 6 months
    • Location data: 3 months

24b. Data Deletion Requests

You may request deletion of your personal data:

  • Through your account settings
  • By contacting connect@racqix.com
  • By submitting a formal deletion request

Note that:

  • Some data may be retained for legal compliance
  • Backup copies may exist for up to 30 days
  • Shared content may remain visible to other users
  • Anonymous/aggregated data may be retained

24c. Mandatory Retention

We must retain certain information:

  • To comply with legal obligations
  • To resolve disputes
  • To enforce our agreements
  • To support business operations
  • To prevent fraud and abuse

24d. Data Export

Before deletion, you may request to export:

  • Your profile information
  • Match history and statistics
  • Communications history
  • Account activity logs

Export requests will be processed within 30 days.

24e. Third-Party Data

Regarding data shared with third parties:

  • We will request deletion from third-party services
  • Third parties may have their own retention policies
  • We cannot guarantee third-party compliance
  • You may need to contact third parties directly
